Agreement to Terms
By accessing or using LoanIntelligence.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use the Service.
Service Description
LoanIntelligence is a loan document data accuracy and quality service that uses proprietary algorithms, signal systems, and SOC 2 Type I and Type II certified third-party AI services to extract structured data, perform financial calculations, and ensure data quality for informational purposes only. The Service includes:
- JSON API for document processing ($1/document, pay-per-use)
- Professional tier with discounted API access ($1,500/month base, includes 1,500 documents at 75¢ each, optional Drive integration add-on for +$250/month)
- Enterprise tier with custom spreadsheet mapping and dedicated support (custom pricing negotiated per customer)
- Data extraction, DSCR/LTV calculations, quality validation, audit trails, and automated underwriting support
Account Requirements
- You must be at least 18 years old to use the Service
- You must provide accurate account information
- You are responsible for maintaining account security
- You must be authorized to bind your organization if using on behalf of a company
- You must comply with all applicable laws and regulations
Pricing & Billing
API Pricing
$1 per document processed. Billed monthly via Stripe based on usage. No minimum commitment.
Subscription Plans
Professional ($1,500/month base, optional +$250/month Drive integration) and Enterprise ($2,500-3,000/month) plans billed monthly in advance via Stripe.
Payment Processing
All payments processed securely through Stripe. You authorize charges to your payment method.
Refunds
API usage is non-refundable. Subscription refunds on a case-by-case basis within 7 days of billing.
Cancellation
Cancel subscriptions anytime. Access continues until end of billing period. No refunds for partial months.
Price Changes
We may change pricing with 30 days notice via email. Continued use after price change constitutes acceptance.
Acceptable Use Policy
Prohibited Activities
- Process documents for illegal purposes or violate laws
- Process documents you don't have rights to access
- Abuse the API (excessive requests, DoS attacks, reverse engineering)
- Use for discriminatory lending, fraud, or harm to others
- Resell API access without written permission
- Scrape, crawl, or harvest data from the Service
Your Responsibilities
- Ensure all documents are lawfully obtained and you have rights to process them
- Comply with FCRA, ECOA, fair lending laws, and data protection regulations
- Verify all extracted data before making financial decisions
- Secure your API keys and account credentials
Intellectual Property
Our Intellectual Property
The Service, API, software, algorithms, and documentation are owned by LoanIntelligence.ai and protected by intellectual property laws. We grant you a limited, non-exclusive license to use the Service.
Your Data
You retain all rights to documents you upload and data extracted from them. We claim no ownership over your data.
Feedback
If you provide feedback or suggestions, we may use them without obligation to you.
Disclaimers & Limitations
Service Provided 'As-Is'
The Service is provided without warranties of any kind. We do not guarantee accuracy, completeness, or reliability of extracted data.
Not Financial Advice
Data quality reports and analysis are for informational purposes only. We do not provide financial, legal, or lending advice. You are responsible for all lending decisions.
No Accuracy Guarantees
While our system is production-ready and highly accurate, we cannot guarantee 100% accuracy. Always verify extracted data against source documents.
Service Availability
We strive for high availability but do not guarantee uninterrupted access. SLAs apply only to Professional and Enterprise tiers.
Third-Party Services
We use third-party AI services that are SOC 2 Type I and Type II certified and contractually prohibited from using your data for training. Google Drive, Stripe, and other integrations are outside our control. We are not liable for third-party service performance or failures.
Limitation of Liability
To the maximum extent permitted by law, LoanIntelligence.ai's total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
This includes damages from: inaccurate data extraction, loan decisions based on our output, business interruption, lost profits, or data loss.
Indemnification
You agree to indemnify and hold LoanIntelligence.ai harmless from claims arising from: (a) your use of the Service, (b) violation of these Terms, (c) violation of laws or third-party rights, or (d) your uploaded documents or data.
Termination
Termination by You
Cancel your account anytime from Dashboard → Settings. Subscription access continues until end of billing period.
Termination by Us
We may suspend or terminate your account for: (a) violation of these Terms, (b) non-payment, (c) fraudulent activity, or (d) excessive API abuse.
Effect of Termination
Upon termination, your access ends immediately. Account data deleted within 24 hours. No refunds for partial periods.
Data Processing Agreement
For GDPR purposes: You are the data controller, we are the data processor. We process personal data only on your instructions (via API calls) using a zero-retention architecture. Documents are NOT stored—they are deleted immediately after processing. Processing results are encrypted with customer-specific keys and stored in YOUR Google Drive. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Binding Arbitration
Disputes will be resolved through binding arbitration in Delaware, not through courts. You waive the right to class actions.
Exceptions
Either party may seek injunctive relief in court for intellectual property violations or urgent matters.
Changes to Terms
We may modify these Terms at any time. Material changes will be announced via email 30 days before taking effect. Continued use after changes constitutes acceptance. If you disagree, you must stop using the Service.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Entire Agreement
These Terms, together with our Privacy Policy and any subscription agreement, constitute the entire agreement between you and LoanIntelligence.ai.
